Oregon & Washington or federal fair housing statutes inquires...
Periodically, an association inquires whether rules and regulations that restrict activities by certain classes of persons such as “children riding bikes” or “adult swim hours” may be construed as discriminatory and violate Oregon, Washington or federal fair housing statutes. Although each association and rule or regulation must be analyzed separately, generally, homeowner association rules that restrict facility use based on age likely do not violate fair housing statutes, unless the rule is so egregious as to effectively prevent protected classes of persons from renting or buying housing within the association.
